Please read these Terms and Conditions ("Terms") carefully before using the Pozy mobile application ("App") operated by MASHINGA LTD ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
By accessing or using Pozy, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. By continuing to use the App, you acknowledge that you have read and accept these Terms and our Privacy Policy.
Subject to your compliance with these Terms, MASHINGA LTD grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on your Apple device solely for your personal, non-commercial purposes. This licence does not include any right to:
To access certain features of Pozy, you must sign in using your Apple ID via Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at pozy@mashinga.uk if you suspect any unauthorised use of your account.
You have the right to delete your account and all associated personal data at any time. Account deletion can be requested directly within the App under Settings, or by contacting us at pozy@mashinga.uk. Upon deletion, all your personal data will be permanently removed from our systems within 30 days, except where we are required to retain certain data to comply with legal obligations. Please note that deleting your account will not automatically cancel any active Pro Pass subscription — you must cancel your subscription separately through your Apple ID account settings prior to deleting your account.
Pozy offers a premium subscription called Pro Pass, available on a monthly basis at $9.99 per month. Pro Pass includes the following features:
Pro Pass features are subject to change. We will notify users of any material changes to the subscription offering.
Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically at the end of each monthly period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings at Settings > [your name] > Subscriptions.
All purchases and subscription payments made through the App are processed by Apple Inc. via the App Store. As Pozy is a digital product, we do not offer refunds for any subscription periods already paid. Apple manages its own refund process independently — if you believe you are entitled to a refund, you may submit a request directly to Apple at reportaproblem.apple.com. MASHINGA LTD has no ability to issue refunds directly and does not intervene in Apple's refund decisions.
The App, including the POZY name and brand, all film emulsion names, visual design, interface elements, graphics, code, and all content created by MASHINGA LTD, is the exclusive intellectual property of MASHINGA LTD and is protected by UK and international intellectual property laws, including copyright and trade mark law.
You may not use, reproduce, distribute, or create derivative works from any of our intellectual property — including film emulsion names and visual assets — without our prior written consent. Nothing in these Terms grants you any right to use our trade marks, trade names, or logos.
The App allows you to upload photographs and other content ("User Content"). You retain ownership of your User Content. By uploading content, you grant MASHINGA LTD a limited licence to store and process that content solely to provide the App's services to you. We do not use your photos for any other purpose, share them with third parties (other than as described in our Privacy Policy), or claim ownership over them.
You agree not to upload content that infringes any third party's intellectual property rights, is unlawful, offensive, defamatory, or obscene, contains malware or harmful code, or violates any applicable law or regulation.
You agree not to use the App to violate any applicable law or regulation, attempt to gain unauthorised access to any part of the App or its related systems, interfere with or disrupt the integrity or performance of the App, or use any automated means to access or scrape the App.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, MASHINGA LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the App. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
