You acknowledge that this EULA is concluded between you and MASHINGA LTD only, and not with Apple Inc. MASHINGA LTD, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
MASHINGA LTD grants you a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code, modify, or create derivative works of the App or any part thereof.
All intellectual property rights in and to the App — including the POZY brand name and trade mark, all film emulsion names, visual design, interface design, graphics, and code — are the exclusive property of MASHINGA LTD. You acquire no ownership rights in the App by virtue of this licence. You may not use, reproduce, or distribute any of MASHINGA LTD's intellectual property without prior written consent.
The App offers a Pro Pass subscription at $9.99 per month, which includes live filter preview (WYSIWYG), no advertisements, 4 free rolls per month, early access to new roll drops, and a Founder member badge.
All subscription payments are processed by Apple Inc. MASHINGA LTD does not store your payment information. As Pozy is a digital product, all sales are final. Refund requests must be submitted directly to Apple at reportaproblem.apple.com.
You may delete your account and all associated personal data at any time via the Settings section within the App or by contacting pozy@mashinga.uk. Account deletion does not automatically cancel your Pro Pass subscription — you must cancel it separately through your Apple ID account settings before deleting your account.
MASHINGA LTD is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services with respect to the App. For support, please contact us at pozy@mashinga.uk.
MASHINGA LTD is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
MASHINGA LTD, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, MASHINGA LTD, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
You represent and warrant that you are not located in a country subject to a UK or US government embargo or designated as a terrorist-supporting country, and that you are not listed on any UK or US government list of prohibited or restricted parties.
The App integrates the following third-party services, each subject to their own terms:
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of these terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
The App is not directed at children under the age of 13. By using the App, you confirm that you are at least 13 years of age.
This EULA is effective until terminated by you or MASHINGA LTD. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
This EULA is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
